1. Scope of Application
   These terms apply to all contracts orders and services in the field of photography and film between [First Name Last Name] (hereinafter "Creator") and the client. Deviating conditions of the client apply only upon explicit written confirmation.
2. Contract Conclusion
   Offers are non binding. A contract is concluded through written order confirmation or commencement of service delivery.
3. Services and Cooperation
   Type and scope of service result from the offer/order confirmation. Artistic design (image conception selection editing) lies with the Creator. The client provides required information access and cooperation promptly.
4. Fee Ancillary and Travel Costs
   The agreed fee plus statutory VAT applies (if charged). Ancillary costs not included in the fee (such as material travel accommodation props external services) are billed separately. Invoices are payable within [14] days without deduction; statutory provisions apply in case of delay.
5. Usage and Exploitation Rights
   The Creator retains ownership of all copyright and usage rights. The client receives usage rights only in the expressly agreed scope (temporal spatial content medium). Rights transfer occurs only after full payment of all claims. Without separate agreement the grant does not include the right to pass on to third parties modify/process or use in media other than agreed. Any use beyond the agreed scope must be arranged beforehand and compensated separately.
6. Attribution
   The Creator has the right to naming according to § 13 Copyright Act. Upon publication the image/film credit "© [First Name Last Name]" must be applied in industry standard manner. If agreed attribution is omitted an surcharge of [100] % of the fee may be calculated.
7. Ownership of Data
   No claim exists for surrender of raw files/unedited files unless expressly agreed. Final edited files in agreed format are delivered.
8. Rights of Depicted Persons and Objects
   The client ensures that required consents of depicted persons (also according to GDPR/Privacy Act) and permissions for depicted objects brands or locations are available where obtaining them falls within their area of responsibility and indemnifies the Creator against third party claims.
9. Appointments Cancellation Rescheduling
   Agreed appointments are binding. If cancelled by the client cancellation fees may arise: [for example up to 14 days before 0 % up to 7 days 50 % thereafter 100 % of the fee] plus already incurred costs.
10. Warranty
    Complaints must be reported immediately at latest within [14] days of delivery in writing. For justified defects the Creator has the right to remedy.
11. Liability
    The Creator bears unlimited liability for intent and gross negligence as well as for injury to life body or health. In case of simple negligence liability applies only for breach of essential contractual obligations and is limited to typical foreseeable damage. Liability for loss of data exists only to the extent the client ensured reasonable data backup.
12. Force Majeure
    In case of force majeure (for example illness official measures technical failures) performances shift appropriately; reimbursement of proven costs remains unaffected.
13. Data Protection
    Processing of personal data occurs according to the Data Protection Policy of this website.
14. Final Provisions
    German Federal Republic law applies. Place of jurisdiction is – if permissible – [City]. If individual provisions are invalid the remainder of the contract remains effective.
